Roundup Settlement Checks in 2021?

2021 has been a rocky road for the Roundup settlement.

It’s been on-again, off-again all year long and meanwhile, about 100,000 plaintiffs are hanging in the balance.

Where Are The Roundup Settlement Checks?

It’s the million-dollar question that’s been on everyone’s mind lately.

Unfortunately, Bayer has not yet finalized a settlement yet.

In June 2021, Bayer reached a verbal deal to settle 85,000 Roundup cancer lawsuits.

Shortly thereafter, the judge presiding over the Roundup lawsuit stated that he was “inclined to reject” Bayer’s settlement offer of about $10 billion before they even presented it. He said it had “glaring flaws”.

Specifically, the judge was not happy with how Bayer proposed to handle future lawsuits.

Up to that point, Bayer was still intent on continuing to market Roundup in the United States. This would inevitably lead to many more lawsuits. The judge, in effect, told Bayer to do better for future claimants.

This sent Bayer scrambling for a way out of the litigation. At this point, it’s still up in the air.

In response, Bayer formulated their “five-point plan“.

Then, in July 2021, Bayer provided an update on the path to the closure of the Roundup litigation. In a nutshell, Bayer said it would petition the US Supreme Court would review a 2021 appeal in which Bayer lost.

Bayer presented two possible scenarios.

Scenario 1

The first scenario would involve Bayer obtaining a favorable decision by the United States Supreme Court on the issue of federal preemption. A favorable decision would almost completely end the Roundup litigation.

Scenario 2

The second scenario would go into effect if the Supreme Court either refuses to hear the federal preemption case or hears it and rules for the plaintiff. In that event, Bayer would enact a claims administration program of its own design.

The company sees good chances for the first scenario and believes there are strong arguments for the U.S. Supreme Court to accept the case and ultimately render a supporting verdict. However, Bayer is also prepared for the second scenario to manage anticipated claims, through settlement and litigation, to ultimately bring an end to this litigation. For this second scenario, the company posts an additional provision of a gross amount of 4.5 billion U.S. dollars (3.8 billion euros), i.e. before tax and discounting in the second quarter 2021, reflecting the company’s potential long-term exposure.

The Supreme Court has not yet revealed whether it will hear the case or not.

In October 2021, Bayer got a bit of good news when it finally won its first jury verdict in a Roundup case.

A jury in California heard a case where Roundup claimed to be the cause of a child’s Burkitt’s lymphoma, which is a rare form of non-Hodgkin’s lymphoma.

The family used Roundup around their house and the jury decided that Roundup was “not a substantial cause” of the child’s cancer.

This is the fourth jury verdict involving Roundup weedkiller and it is the first that has been decided in the company’s favor.

But Are Roundup Settlement Checks Coming in 2021?

Everyone seemed to think things would be over quickly after Monsanto was ordered to pay $289 million in the first Roundup case, but that just wasn’t to be.

Although no one can say with 100% certainty until December 31, 2021, we put the likelihood of Roundup settlement checks being sent out in the next month and a half as HIGHLY UNLIKELY.
