While trials, negotiations, and a potential global settlement are underway, plaintiffs diagnosed with non-Hodgkin lymphoma (NHL) have already faced an undue economic burden. However, the outcomes of recent lawsuits have been very promising.

Who Is Monsanto?

Established in 1901, Monsanto has transformed from a chemical company into a corporation focused on agricultural biotechnology. In June 2018, Bayer AG bought it as a part of its crop science division.

Monsanto’s popular lines include crop seeds, row crops, and glyphosate herbicides, among which is the Roundup brand.

Roundup, one of its top revenue drivers, has remained useful to farmers. First, they use Roundup Ready to raise crops that are immune to the chemicals found in Roundup. Then, they simply blasted their fields with the weedkiller, and poof, the weeds are dead.

But according to reports, while Roundup products make the lives of agricultural workers easier, they have dangerous, potentially fatal side effects.

What Is the Monsanto Roundup Lawsuit Controversy?

Roundup is the brand of a glyphosate-based herbicide produced by Monsanto. Aside from the active ingredient, its formulation includes surfactants. It was marketed in 1973 after Monsanto developed and patented the glyphosate molecule. The patent expired in 2000.

After the IARC reported on the link between glyphosate and cancer in humans in 2015, thousands of plaintiffs filed state and federal lawsuits over Roundup. They claimed their cancer had been caused by exposure to the herbicide.

What Is Glyphosate?

Glyphosate is one of the most common herbicides in the world. In the United States, it is used by gardeners, farmers, and agricultural workers. It is so popular that Roundup, which contains glyphosate, continues to bring in a tenth of Monsanto’s revenue.

Glyphosate can be sprayed on GMO and non-GMO crops, helping them grow and ripen while getting weeds out of the way. This means some food may have it at above-average levels. Oat-based products are one example, with breakfast staples like Quaker Old Fashioned Oats and Cheerios showing up in the news.

The Environmental Protection Agency (EPA) maintains that glyphosate has low toxicity for people.

Despite the controversy surrounding this chemical and the Monsanto brand, American farmers and longtime customers are not deterred and continue using Roundup.

 

Link Between Glyphosate and Cancer

An IARC report states that glyphosate is “probably carcinogenic to humans”. On the other hand, both the EPA and Bayer claim there is no meaningful connection between glyphosate and cancer.

Yet, EPA may be wrong about its dangers. The risk may increase if the herbicide is used the wrong way and the exposure is high.

In particular, the exposure of farmers, groundskeepers, gardeners, and the like to the chemical increases the risk of non-Hodgkin lymphoma.

Link Between Roundup and Non-Hodgkin Lymphoma

Plaintiffs of Roundup cases claim their exposure to Roundup directly caused their blood cancer.

In the lawsuits, they cite Monsanto’s failure to inform them about the dangers of using the product, particularly the development of NHL.

Roundup contains 41% glyphosate, which is classified as “probably carcinogenic” to humans by the IARC. It belongs to Group 2A, which includes red meat, shiftwork that disrupts circadian cycles, exposure to petroleum refining at work, and frying at high temperatures.

Has Anyone Won a Roundup Suit or Received a Settlement from Monsanto?

Bayer, Monsanto’s owner, has not agreed to any settlement as of June 15, 2020. However, reports say the German firm plans to settle a significant number of claims and will announce the details at the end of June.

Meanwhile, Monsanto has already lost three huge verdicts, partially causing its stock value to plummet.

  • School groundskeeper Dewayne Anthony Lee Johnson was awarded nearly $80 million in damages in August 2018. Mr. Johnson used to spray Roundup up to 30 times every summer. With terminal cancer (also NHL), he fears he may not live long enough to get the money.
  • Gardeners Alva and Alberta Pilliod won $2.05 billion in a suit in May 2019. Both have NHL and used Monsanto’s Roundup spray to clear their driveway of weeds for two decades.

What Is the Future for Monsanto Roundup Plaintiffs?

At the end of June, Monsanto’s parent company Bayer AG will announce its plans to settle a substantial portion of its U.S. lawsuits for $10 billion. This considerable move has involved high-stakes mediation talks, according to Bloomberg.

While no details have been disclosed, the deals are estimated to cover 50,000 to 85,000 claims. Plaintiffs can receive a few thousands to a few millions each in settlement payout.

Avoiding jury trials is a priority for Bayer, which inherited the costly legal battle when it acquired Monsanto in 2018. The company seeks to improve Monsanto’s share price, which has declined throughout the lifetime of these suits and three U.S. court trials.
